A jurat is a formal statement attached to a document, typically an affidavit or deposition, that verifies it was signed under oath before a notary public. It is the second most common type of notary certificate. It is usually used for “sworn statements” or “affidavits.” The proper jurat wording can be identified by the words “subscribed and sworn.” 

If a person, called the principal, has signed a document but does not personally appear before a notary public, another person can appear on the principal’s behalf to prove the principal signed (or “executed”) the document. That person is called a subscribing witness. 

A proof of execution by a subscribing witness cannot be used in conjunction with any power of attorney, quitclaim deed, grant deed (other than a trustee’s deed resulting from a decree of foreclosure, or a nonjudicial foreclosure pursuant to Civil Code section 2924, or to a deed of reconveyance), mortgage, deed of trust, security agreement, any instrument affecting real property, or any instrument requiring a notary public to obtain a thumbprint from the party signing the document in the notary public’s journal. 

Living Wills and Trusts

A trust is valid after the trustor signs the document, they don't need to have the document witnessed or notarized to make it valid. However, many individuals choose to sign their document in the presence of a notary public to help authenticate the document.

Deeds and Title Transfers

Notarizing the deed adds validity. The grantor signs the deed in the presence of a notary public. The executed deed is delivered to the buyer and recorded with the county recorder's office. Recording establishes the buyer's legal ownership and provides notice to the public.

Lease Agreements

If applicable, preferred or required, notarizing a lease/rental agreement is an option to add a layer of protection for both parties.
