Legal videography services for document signings provide a professional and secure method of recording important legal processes, ensuring that the signing of documents is accurately documented on video. These services are often utilized for situations where a clear, indisputable record of the signing is necessary, such as in the execution of wills, contracts, property deeds, affidavits, and other legal documents. A skilled legal videographer will set up high-quality recording equipment, ensuring optimal lighting and sound conditions to capture clear visuals and audio.
A Notary Public is required to conduct this recording.
The form most completed by the notary public is the acknowledgement. A notary acknowledgement certifies that the signer of a document is who they say they are, personally appeared before the notary public on the date indicated and the county indicated on the acknowledgement form, and that the signer acknowledged executing the document.
A jurat is a formal statement attached to a document, typically an affidavit or deposition, that verifies it was signed under oath before a notary public. It is the second most common type of notary certificate. It is usually used for “sworn statements” or “affidavits.” The proper jurat wording can be identified by the words “subscribed and sworn.”
A California Notary Public can certify copies of power of attorney. A certified copy of a power of attorney that has been certified by a notary public has the same force and effect as the original power of attorney. The certification shall state that the certifying person (i.e., notary public) has examined the original power of attorney and the copy and that the copy is a true and correct copy of the original power of attorney.
If a person, called the principal, has signed a document but does not personally appear before a notary public, another person can appear on the principal’s behalf to prove the principal signed (or “executed”) the document. That person is called a subscribing witness.
A proof of execution by a subscribing witness cannot be used in conjunction with any power of attorney, quitclaim deed, grant deed (other than a trustee’s deed resulting from a decree of foreclosure, or a nonjudicial foreclosure pursuant to Civil Code section 2924, or to a deed of reconveyance), mortgage, deed of trust, security agreement, any instrument affecting real property, or any instrument requiring a notary public to obtain a thumbprint from the party signing the document in the notary public’s journal.
Affidavits are one of the most widely used types of legal documents.
An affidavit is a written statement in which the signer or "affiant" verifies that the document is true. They differ from sworn oaths only in that the relevant parties must sign them instead of swearing them out loud. The person swearing to this written statement is called the affiant.
Living Wills and Trusts
A trust is valid after the trustor signs the document, they don't need to have the document witnessed or notarized to make it valid. However, many individuals choose to sign their document in the presence of a notary public to help authenticate the document.
Deeds and Title Transfers
Notarizing the deed adds validity. The grantor signs the deed in the presence of a notary public. The executed deed is delivered to the buyer and recorded with the county recorder's office. Recording establishes the buyer's legal ownership and provides notice to the public.
Lease Agreements
If applicable, preferred or required, notarizing a lease/rental agreement is an option to add a layer of protection for both parties.
Demand Letter
Demand Letters explain your position to the other party. Demand letters not only help the other person understand the dispute from your point of view, but also help you think through every aspect of your case, including the important facts, your legal arguments, and the evidence you'll need to prove your claim.
