What Is An Affidavit

Affidavits are one of the most widely used types of legal documents.

An affidavit is a written statement in which the signer or "affiant" verifies that the document is true. They differ from sworn oaths only in that the relevant parties must sign them instead of swearing them out loud. The person swearing to this written statement is called the affiant. 

They are often more convenient than swearing an oath because they do not require the person attesting the information to be present. They are an accurate way to keep records of vital details for court cases and other proceedings.

Affidavits include a sworn statement made by the affiant and witnessed by a notary or officer of the law. This statement attests that the facts included in the affidavit are true to the best of the affiant's personal knowledge. Legal proceedings use these documents to verify evidence for inclusion in trials and other functions.

Voluntary

Affiants must make the oath featured in their affidavit voluntarily. Their legal representation must prove that no one has pressured the affiant into signing.


Signed

An affidavit must be signed by the person making the statement to be considered legally binding. In many cases, the affiant must also sign the document in front of a witness. That witness is often the notary public, but they could be anyone willing to swear the signature is authentic.


Notarized

Notarization is the most secure way for a court to authenticate an affidavit’s authenticity.

Applicable Uses of Affidavits

These documents are among the most commonly used in legal proceedings for these cases below:

  • Contract work. Contractors working on government projects submit these documents to verify that they've withheld the state taxes.
  • Estate planning: Affidavits signed by the estate's owner must accompany estate planning documents such as wills.
  • Financial statements. In bankruptcy and divorce cases, courts may use financial affidavits to verify relevant financial information. 
  • Verification of residence. These documents are a common way for someone to verify their address in the absence of other proof.
  • Marriage. Subjects can use these documents in place of a marriage certificate to verify a person’s marital status. 
  • Service. When legal representation files documents, they must submit an affidavit of service along with them. This confirms that the court officers served the documents to all relevant parties. 
  • Verification of domicile. When a person dies, their executor can sign an affidavit confirming their final place of residence.

Affidavits are used in a variety of legal situations, including:

There are many types of affidavits, but some common ones include:

  • Affidavit of identity: Verifies a person's name, date of birth, and other identifying information.
  • Affidavit of lost document: Provides proof that a document has been lost or misplaced.
  • Affidavit of domicile: Establishes a person's residency in a particular location.
  • Affidavit of support: Used in immigration proceedings to demonstrate financial support for an immigrant.


While you can find affidavit templates online, it's advisable to consult with an attorney to ensure it's properly drafted and meets the specific requirements for your situation.


Once you sign the affidavit in front of a notary public and have it notarized, you can typically file it with the appropriate court, agency, or individual. Remember, making false statements in an affidavit is perjury, which is a serious crime.


  • Title: This identifies the document as an affidavit.
  • Introduction: This states the affiant's name, address, and capacity (e.g., personal knowledge of the facts).
  • Body: This is where the affiant details the facts they are swearing to be true.
  • Jurat: This is a section at the end of the affidavit that is completed and signed by the notary public. It verifies that the affiant signed the document under oath (or affirmation).


While not always mandatory, it can be helpful to consult with an attorney, especially if the affidavit will be used in a legal proceeding.  An attorney can ensure the affidavit is drafted correctly and that it includes all the necessary information.


In most cases, affidavits  do require notarization  to be valid. The notary public verifies the affiant's identity and witnesses their signature, adding an official layer to the document.


Notary fees vary depending on location and complexity of the signing. It's always best to ask the notary public about their fees upfront.


Anyone with personal knowledge of the facts being stated can create an affidavit.


  • Immigration: Affidavits of support or financial affidavits are often required in immigration applications.
  • Travel:  Affidavits may be needed for visa applications or to prove parental consent for minors traveling alone.
